Sidekick To Do: Privacy Policy & Terms of Use

This document constitutes the entire legal agreement between you ("the User") and the developers of Sidekick To Do ("we," "our," or "the App"). By installing, accessing, or using Sidekick To Do, you explicitly agree to the data handling practices, limitations of liability, and terms outlined below.

1. Data Privacy & Local Storage (Information We Do Not Collect)

The core functionalities of Sidekick To Do operate entirely on your device to maximize your personal privacy.

• Your Data Stays Yours: Your task lists, project hierarchies, productivity data, and any personal configurations are stored strictly locally on your device’s secure internal storage.
• No Cloud Databases: We do not host, own, or maintain any cloud databases that store your personal task data. We have zero visibility into what you write in your lists or how you organize your day.

2. Third-Party Data Processing & Integrations (Information We Transmit)

To power app features, user onboarding, and third-party integrations, the App securely transmits specific data over the wire only when required:

• New User Registration & Developer Notifications (Discord): When you first set up the App or provide your first name (or preferred alias), this information is transmitted to our developer backend and relayed via a third-party webhook service (Discord). This transmission is used solely by the developer to track new user registrations, monitor app growth, and manage internal operational analytics. This data is kept strictly confidential by the developer and is never sold, rented, or shared for advertising purposes.
• AI Agent Processing (Pro Subscription Users Only): Advanced AI capabilities—including the Sidekick AI Agent (voice and text messaging), smart task creation, and AI image features—are available exclusively to users subscribed to Sidekick Pro. When a Pro user interacts with these features, the App transmits the inputted prompts, along with the user's first name (or preferred alias), to our backend infrastructure. These requests are securely routed via HTTPS to OpenRouter (an API aggregation service), which acts as a secure proxy to deliver prompts to advanced Large Language Model (LLM) endpoints. We configure our integration to ensure prompt and completion text are not logged by OpenRouter, are not retained, and are never used to train public AI models by OpenRouter or its downstream model providers.
• Weather API Location Services (Pro Subscription Users Only): For Pro users utilizing our automated weather integrations, the App can transmit your device's geographical location data to a third-party weather API provider to fetch real-time local forecasts.
  • Strictly Opt-In: This feature is entirely voluntary and turned off by default. Your location data is only transmitted if you explicitly enable location permissions and toggle the feature on in the App's settings.
  • Total Control: You can completely disable this location data transmission at any time inside the App settings. If disabled, weather features will cease to pull local data, and your location will remain entirely local to your device.

3. Data Deletion, Control, and Tracking

Because your personal data is stored locally on your device, you have total control over it:

• Instant Deletion: You can delete your first name, stored locations, and all task lists at any time simply by clearing the App's data in your device settings or by uninstalling the App.
• No Commercial Exploitation: We do not track your physical location in the background, nor do we sell, rent, or trade any user data to third-party advertisers, data brokers, or external entities.

4. Fair Use Policy & Feature Limitations

To maintain network stability, prevent service abuse, and manage operational API costs, all advanced features in Sidekick To Do are subject to our Fair Use Policy:

• Reasonable Usage Allowed: We intend for all our Sidekick Pro subscribers to enjoy generous, reasonable access to our advanced features, including AI agent conversations, photo/picture uploads, AI photo generations, and real-time weather data calls.
• Imposition of Caps: The developers reserve the right, at their sole discretion, to monitor usage patterns and impose certain structural Fair Use limits or temporary throttling thresholds on any account. This includes modifying, restricting, or limiting the maximum volume of AI messages sent, which can be capped by the hour, day, week, or month, as well as capping image/document uploads, restricting image generation credits, or limiting the frequency of automated weather API refreshes.

5. STRICT LIMITATION OF LIABILITY & WARRANTY DISCLAIMER

• As-Is Provision: Sidekick To Do is provided to you on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.
• Absolute Assumption of Risk: Because Sidekick To Do stores all data locally on your device, the preservation, maintenance, and safety of that data is your sole responsibility. The developers of Sidekick To Do assume absolutely no responsibility or liability for any data loss, data corruption, or interrupted access to your lists, regardless of the cause.
• Exclusion of Financial Damages: Under no circumstances shall the developers be liable for any direct, indirect, incidental, special, or consequential damages—including, but not limited to, loss of profits, loss of money, business interruption, or financial losses—resulting from the use of, or inability to use, this App, even if advised of the possibility of such damages.
• Causes of Loss: The developers shall not be liable for any data or financial loss resulting from app updates, software bugs, operating system crashes, infrastructure downtime, device damage, device theft, hardware failure, or accidental user deletion.
• Mandatory Backup Recommendation: To safeguard your critical information, we strongly encourage and expect users to actively utilize native mobile operating system backup functions (such as Google One Backup for Android or iCloud Backup for iOS) to regularly back up their device data.

6. AI Accuracy & Professional Advice Disclaimer

The Sidekick AI Agent utilizes advanced machine learning technology. While designed to be a helpful productivity assistant, you explicitly acknowledge and agree to the following limitations:

• Not a Substitute for Professional Advice: The outputs generated by the Sidekick AI Agent are for informational and productivity purposes only. They do not constitute, and should never be used as a substitute for, professional medical, legal, financial, tax, or investment advice.
• Verify Independently: Users should independently verify critical details. The developers assume no liability for actions taken, decisions made, or financial investments attempted based on AI-generated responses. You bear full responsibility for your reliance on any information provided by the AI features.

7. Changes to This Agreement

We reserve the right to update this document from time to time to reflect changes in our app architecture, resource costs, or evolving legal compliance. Any changes will be posted within the App or on our store listing page, with an updated "Last Updated" date at the top. Your continued use of the App following any changes constitutes acceptance of the new terms.
